We use your personal information to provide you with the Services in order to perform our contract with you, including to process your payments, fulfill your orders, to send notifications to you related to your account, purchases, returns, exchanges or other transactions, to create, maintain and otherwise manage your account, to arrange for shipping, facilitate any returns and exchanges and to enable you to post reviews;

Children’s Data

The Services are not intended to be used by children, and we do not knowingly collect any personal information about children. As of the Effective Date of this Privacy Policy, we do not have actual knowledge that we “share” or “sell” (as those terms are defined in applicable law) personal information of individuals under 16 years of age.

How to Opt Out of Sale, Sharing, and Targeted Advertising

You can opt out of the “sale” or “sharing” of your personal information and the processing of your personal information for targeted advertising through any of the following methods:

Commercial Electronic Messages (CASL)

Where required by applicable law, including Canada’s Anti-Spam Legislation (CASL), we will only send you commercial electronic messages (such as marketing emails) if we have your express or implied consent. When you sign up for our email list or make a purchase, we will only add you to marketing communications on the basis permitted by the law that applies to you; we do not use pre-checked consent boxes. Every commercial electronic message we send will identify us, include our mailing address, and contain a functioning unsubscribe mechanism. You may withdraw your consent or unsubscribe at any time by using the unsubscribe link in any of our emails or by contacting us at support@cavemantools.com; we will give effect to your unsubscribe request within the time required by applicable law (no later than ten (10) business days under CASL).

Notice for California Residents

If you are a California resident, the California Consumer Privacy Act, as amended (“CCPA”), requires us to provide you with additional information regarding your “personal information,” as defined in the CCPA. California “Shine the Light” Disclosure. California Civil Code § 1798.83 gives California residents the right to opt out of our disclosure of certain categories of personal information to third parties for those third parties’ direct marketing purposes. Deletion exceptions. We may deny a deletion request, or retain certain information, where retention is reasonably necessary to: complete the transaction for which the information was collected, fulfill the terms of a written warranty or product recall, or otherwise perform our contract with you; detect security incidents or protect against malicious, deceptive, fraudulent, or illegal activity; debug products to identify and repair errors; exercise free speech or another right provided for by law; comply with a legal obligation (including tax and record-keeping laws); engage in lawful internal uses compatible with the context in which you provided the information; or as otherwise permitted by applicable law.

Exercising your rights. We will respond to a verifiable request within forty-five (45) days of receipt; if we require more time (up to an additional forty-five (45) days), we will inform you of the reason and extension period in writing. Nevada residents have the right to request that a company not “sell” their “covered information” (as those terms are defined in Nevada Revised Statutes Chapter 603A) to certain other parties. Notice for Canadian Residents (PIPEDA)

If you are a resident of Canada, the Personal Information Protection and Electronic Documents Act (“PIPEDA”) and substantially similar provincial legislation give you the right to request access to the personal information we hold about you, to request correction of inaccurate personal information, and to withdraw your consent to our collection, use, or disclosure of your personal information (subject to legal and contractual restrictions and reasonable notice; withdrawing consent may affect our ability to provide you with the Services). International Users

Please note that we may transfer, store and process your personal information outside the country you live in, including the United States. Your personal information is also processed by staff and third-party service providers and partners in these countries. If we transfer your personal information out of Europe, we will rely on recognized transfer mechanisms like the European Commission’s Standard Contractual Clauses, or any equivalent contracts issued by the relevant competent authority of the UK, as relevant, unless the data transfer is to a country that has been determined to provide an adequate level of protection.
